These Terms are effective as of the date stated above. Play It Right may revise these Terms at any time and from time to time. If you do not agree to any revisions to these Terms, please stop using our website and/or you may cancel your account with us by contacting us at support@playitright.com. Modification of these Terms orally or otherwise cannot be carried out by our employees. If you are offered to modify the provisions of these Terms by any of our employees, he/she is not speaking on the Company’s behalf.

The use of our service is limited to users that are of legal age and residing in the Philippines. By accessing our Site, you represent and warrant that you are eighteen (18) years old and above. If you are under eighteen (18) years old, you should use our Site only with a parent or guardian's involvement.

You agree to access and/or use our Sites for lawful purposes and in a lawful manner at all times and only in accordance with these Terms. Moreover, you agree that you will not:

• Gain access to any segment of our Sites by hacking or any other unlawful means;
• Create a link from our Sites to another website without our prior written agreement;
• Display our Sites on another site, application or location, without our prior written permission;
• Change the information on our Sites or publish any such materials for any public, non-personal or commercial purpose;
• Use any deep-link or any other similar process, to access any segment of our Sites;
• Gather any information about our users and/or their devices;
• Generate uninvited electronic communications, such as spam, to interfere with the proper functioning of our Sites;
• Upload to our Site anything that contains a virus or any malicious code that can harm our Site, affect our Site security and/or affect a user;
• Post any unlawful or illegal material to our Site;
• Analyze the vulnerability of our Site;
• Access our Site in any manner which would violate any applicable law; or
• Attack our Site via a denial-of-service attack.

You may create an account to submit an order on our Site. If you choose to create an account, you are responsible for keeping your account's confidentiality and any information associated with it. You are also responsible for all the activities under your account, whether authorized or unauthorized. You must immediately notify Us if there is any unauthorized third-party access or use of your account.

We reserve the right to terminate your account if we become aware that you are under eighteen (18) years old. If you are under eighteen (18) years old, you may only use our Site with a parent or a guardian's involvement. 

We reserve the right to disregard your account in order to protect your account and our system if we determine that your personal device is being infected by a virus (or anything similar) or due to the theft of your account information.

All features, content, availability, products, and prices of products depicted on our Sites are subject to change at any time without prior notice. We endeavor that the information on our Sites is complete, accurate and up-to-date, including the applicable colors; however, the actual color you see depends on your device set-up, and we cannot guarantee that your device will accurately display such colors. Despite our efforts, the information on our Sites may occasionally be inaccurate, incomplete, or out-of-date. All listed prices are subject to taxes unless otherwise stated.

When a product order is placed for delivery, it will be shipped to the address indicated by the customer who placed the order. To the extent permitted by law, we shall not be liable for any loss, liability, cost, damage, charge or expense arising from late delivery. Upon delivery of the product, you may be required to sign for the delivery. You may contact Play It Right Customer Support Team at support@playitright.com in case of any fault, defect or damage. You must provide the documents delivered with the product, upon request. There may be certain locations that are "out of serviceable areas". In this case, we will inform you using the contact details you have provided when placing your order and arrange for cancellation of the order or delivery to an alternative delivery address. All deliveries are in standard packaging. Please see Delivery Guidelines for more information. 

All materials such as illustrations, photographs, videos, audios, logos or any graphics published on this platform are owned, licensed to or controlled by us and are protected by intellectual property laws. We reserve the right to enforce our intellectual property rights to the fullest extent of the law.

As a user of our Sites, you will have access to post content on our Sites such as comments, reviews, suggestions and profile information. Once you participate in our Sites, your posted information may be shared with other users. Subject to any licenses and rights granted herein, any user content posted by you is owned by you. We reserve the right to remove any content posted by a user that, in our discretion, is violating these Terms, applicable data privacy laws and our Privacy Policy and reserve the right to cut off the user's access.

You are solely responsible for the content you post. You will only post user content that you believe to be true and accurate, and you will not post anything that may be false, misleading or fraudulent. You are restricted from posting any content that:

Information of any person without consent from such person or in violation of applicable laws

• Is unreliable, misleading, fraudulent, unlawful, threatening, defamatory, libelous, obscene, pornographic, or profane;
• Advocates illegal activity or violates any law;
• Violates the rights of a third party;
• Is offensive to other users such as promoting racism, bigotry or hatred; or
• Harasses another person

You understand that we have limited control over the contents posted by other users on our Sites and we do not assure the accuracy and quality of these contents.

There may be links on our Sites interacting with third-party sites that we do not own, control, nor operate. We are not responsible for any content or materials from any other site.

We do not warrant that our Sites (or its servers) will be error-free, uninterrupted, free from viruses or otherwise meet your device's technical requirements.

You agree to defend, indemnify and hold Molten and its respective affiliates, employees, harmless from and against any losses, costs, expenses or damages of any nature whatsoever, including attorneys' fees and court costs, arising from any claim, cause of action, suit or demand of any third party due to, arising out of or relating to your breach of these Terms.

If you believe a user’s content infringes your copyright, you can send us written notice of the alleged copyright infringement to support@playitright.com/privacy@playitright.com. 

1. Initial Dispute Resolution. You can contact us through email at support@playitright.com to raise any concerns regarding your use of our Sites. 
2. Philippine Law. These Terms and your use of our Sites shall be governed by and interpreted in accordance with Philippine law. You submit to the Philippines courts' exclusive jurisdiction to settle any dispute that may arise under these Terms.

No waiver by either party of any term or condition outlined in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any party's failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Molten with respect to our Sites and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to our Sites.

You are personally responsible for any activity on your account. We reserve the right to terminate your account, for any or no reason.
